LEGAL NOTICE

DC HERNÁNDEZ ABOGADOS, S.C. (DC) makes available this PRIVACY NOTICE to you, in compliance to what is set forth by the Federal Law of Personal Data Protection in Possession of Particulars, its Regulations and the rest of the applicable standards of the matter with the purpose to guarantee our responsibility to procure at any time the legitimate, controlled and informed treatment of personal data of our clients, suppliers, collaborators and any third party.

DC, is a legally incorporated company pursuant to the Mexican Laws guaranteeing privacy of its clients and any individual sharing personal data or any type of confidential information, through the outmost strict physical, technical and administrative security measures, it with the purpose to help to your personal and confidential information protection.

Our domicile is located in Corporativo Terraza Amalfi, Office 8, Esmeralda Plaza 9, Rancho Viejo Quarter, Atizapán, Mexico, Z.C. 52930.

The purpose of the hereby Privacy Notice is to let you know the holders of personal data ( our clients, suppliers and collaborators or any third party with which in the future we would establish any professional relation, juridical, commercial or business agreement), that has provided his/her personal data to DC, that DC obliges to keep confidentiality of such data, as well as to safeguard them under the most strict security measures, as well as any type of information coming from the aforementioned persons, independently that these are legal persons or entities.

By virtue of the latter in DC we can gather the following information that is detailed next about legal persons:

  1. Contact Information: name, domicile telephone, electronic mail.
  1. Identification Information: date of birth, Population Registry Sole Code (PRSC) (CURP), social security number.
  1. Academic and/or Labour Information: academic degree, educational and labour trajectory, professional schedule number, evidences accrediting such credentials.
  1. Invoicing and/or Bank Data: fiscal data such as name or company’s name of the taxpayer, Federal Taxpayer Number (FTN) (RFC), fiscal domicile, banking accounts data, specifically account number and/or CLABE interbanking code, SWIFT and/or ABA, as well as the name of the Banking Institution.

In principle, DC does not gather sensitive personal data, that are those affecting the most intimate sphere of its holder, or which undue use can give origin to discrimination or leads to a serious risk for him/her; in particular, are deemed sensitive those that can disclose aspects such as racial or ethnic origin, state of present and future health, genetic, financial, patrimonial information, religious, philosophical and moral believes, union affiliation, political opinions and sexual preference.

However, if derived from the professional relation, of business or of any other type between the responsible persona and the concerned (holder of personal data), would be gather any accurate data for maintenance or compliance of such performance and this could be considered as sensitive, the written consent shall be obtained by means of the acknowledgement of receipt read of the hereby Privacy Notice.

In DC personal data obtained from legal persons, have the purpose to give origin and/or are necessary to initiate or maintain a professional, business or any other type of relationship existing or that would exist between the responsible person and the concerned (holder of the personal data).

For DC it is indispensable to set forth how we use, share and protect your personal and confidential information; it is for it that we establish and maintain security, administrative, technical and physical measures, in attention to the gathered data sensitivity, which allow us to protect personal data against damage, loss, alteration, destruction or the use, access, disclosure or not authorised treatment; such measures are minor to those that we maintain for handling our own information.

DC, in no time shall sell, assign, share nor transfer your personal data to third parties foreign to DC, without your previous consent and without this derives from a legal obligation by DC, whenever it is necessary or convenient for DC may divulge the information provided that a resolution is dictated from competent authority in a judicial proceeding, whenever is requested by a governmental authority or in any of the cases demanded by the applicable normativity.  Can also be able to divulge the information whenever it is necessary or convenient to protect your Internet site or rights.

DC reserves the right to share your personal data with its partners, associates, consultants and the rest employees by nature of the professional services that DC offers, this taking into account that we all forming part of DC, know and understand the scope of handling privileged confidential information and personal data treatment.

To such third parties we request that once ended the commercial relation, of business or of any other nature, keep confidentiality with respect to the information provided, we also request to destroy, suppress or return them at the end of the relation that gave origin to the transfer thereof.

The authorisation by the holder of the personal data for transfer of personal data shall be obtained by means of the acknowledgement of receipt read of the hereby notice.

Likewise that many web sites of today, in our Internet Portal www.www.dcabogados.mx we can employ technologies called “cookies” (brief text archives that can be stored in the user navigator and/or “beacons” (electronic images allowing to the web site to count the number of visitors entered to a page and access to certain cookies), with the purpose to offer a better experience measuring which areas of our web site of higher interest or to remember  whenever visit us again.  We have no wish or intention to infringe your privacy while you visit our site.  The majority of navigators shall allow to erase the cookies from the computer’s hard disk to block cookies acceptance or to receive a warning before storing a cookie.  You can take that option to configurate your navigator so that it notifies whenever you receive a cookie, giving it the option to reject or accept the cookie.  Cookies can also be used by third parties serving to ad-companies that have to place advertisements in our web site and control of the announcement shown.  These “ad serving” companies can use cookies to gather no identifiable personal information from you.  Advertisers use this information to orient announcements and measure their impact.  It is important to take into account not to place nor use these cookies.

As personal data holder, you or your legal representative can exercise  the rights of Access, Rectification, Cancellation or Opposition (known as ARCO Rights), by means of correspondence addressed to privacidad@www.dcabogados.mx or to the domicile pointed out in the hereby notice.

In both cases the request must contain the name and domicile of the personal data holder, furthermore of the requisites pointed out by the Law and state therein, in a clear manner the right you want to exercise.  It is important to point out that if in any of the cases there is no acknowledgement of receipt by DC, shall be deemed for not received such request (the acknowledgement of receipt shall be given by the means which has been filed).

The reply to your request shall be given in the terms pointed out by the laws of matter by the same means that the request has been performed.

In terms of the provisions of the matter, we let you know that before the deny of response to your ARCO RIGHT REQUEST or in conformity with it, you can file before the National Institute of Transparency, Access to Information and Personal Data Protection (INAI), the corresponding request in the terms set forth by the Law.

In case of doubts or comments about the hereby Privacy Notice we request to contact the responsible for and/or person in charge of  the personal data, either by telephone, electronic mail or personally coming to our offices.
